Terms of Service

These Terms of Service ("Terms") govern your use of SaasDash.ai, a SaaS metrics dashboard operated by Pmc Negocios Digitais Ltda, CNPJ 50.541.698/0001-20, with registered address at Rua Doutor Itapura de Miranda, 100 — Boqueirão, Santos — SP, 11.055-090, Brazil ("SaasDash", "we", "us", "our"). By creating an account or using our service, you agree to these Terms. If you do not agree, do not use SaasDash.ai.

1. Description of Service

SaasDash.ai is a metrics dashboard for SaaS founders based on industry-proven SaaS growth methodologies. The platform provides revenue ceiling prediction, scenario modeling, business health audits, CAC and NRR calculators, AI-powered insights, activation tracking, weekly pulse checks, an affiliate program, NPS surveys, and a Wall of Fame testimonials feature.

2. Account Registration

You may sign in using a valid Google account, a valid GitHub account, or by requesting a passwordless magic link delivered to your email (Resend). You are responsible for maintaining the security of your account and for all activity that occurs under it. You must provide accurate information and keep it up to date. Each individual should maintain only one account.

3. Plans & Pricing

We offer four subscription plans:

• Free ($0/month) — Growth Ceiling calculator, basic metrics, ceiling visualization. 1 team member, no history retention.
• Starter ($49/month or $470/year) — Adds CAC, weekly pulse, scenarios, goals, affiliate program, and Wall of Fame. 1 team member, 3 months of history, up to 3 scenarios.
• Growth ($99/month or $950/year) — Adds hourglass audit, activation tracking, NRR, team collaboration, audit logs, AI chat, and AI activation advisor. Up to 3 team members, 12 months of history, 50 AI credits/month.
• Scale ($249/month or $2,390/year) — All features, BYOK (Bring Your Own Key), unlimited history, unlimited scenarios and goals. Up to 10 team members, 200 AI credits/month.

Prices are in USD and may be updated with 30 days' notice. Plan features and limits are subject to change. Current plan details are always available on our pricing page.

4. AI Credits & Usage

AI features (Ask Science, Activation Advisor) consume credits. Each plan includes a monthly credit allocation that resets at the start of each billing cycle. Unused credits do not roll over. Additional credit packs may be purchased as one-time add-ons. Credits may expire if unused for an extended period. On the Scale plan, you may use your own Anthropic API key (BYOK) to bypass the credit system; you are solely responsible for any charges incurred on your Anthropic account.

5. Payments & Billing

All paid subscriptions are billed in advance on a monthly or annual basis through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis. You can manage your subscription, update payment methods, or cancel via the Stripe Customer Portal accessible from your account settings.

Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused portions of a billing cycle. Downgrading to a lower plan may result in loss of access to features and data beyond the limits of the new plan.

6. EU Consumers — Right of Withdrawal

If you are a consumer in the European Union, the United Kingdom, or another jurisdiction that grants a statutory right of withdrawal for digital services (Directive 2011/83/EU, Art. 16(m) as transposed into national law), you ordinarily have 14 days from the start of your subscription to withdraw. SaasDash.ai is a digital service delivered immediately upon successful payment. By completing checkout and ticking the corresponding consent at signup, you expressly request immediate performance and acknowledge that you lose the right of withdrawal once we begin providing access to the service.

If you have not yet logged in or used any feature after subscribing, you may still request a full refund within 14 days by emailing legal@saasdash.ai.

7. Affiliate Program

Eligible users on Starter plans or above may join our affiliate program. Affiliates earn a 20% recurring commission on payments from referred customers for up to 12 months from the referral date. Commissions are subject to a 30-day lock period before becoming eligible for payout. Minimum payout threshold is $50.00. Payouts are processed monthly via Stripe Connect.

Affiliates must not use misleading advertising, spam, or any deceptive practices to generate referrals. We reserve the right to suspend or terminate affiliate accounts that violate these guidelines, and to withhold commissions earned through fraudulent activity.

8. Testimonials & Wall of Fame

By submitting a testimonial through our Wall of Fame feature, you grant SaasDash.ai a non-exclusive, royalty-free, worldwide license to display your story, name, role, and company name on our website and marketing materials. All testimonials are subject to review and approval before publication. You may request removal of your testimonial at any time by contacting us.

9. Acceptable Use

You agree not to:

• Attempt prompt injection, jailbreak, or other attacks against our AI systems;
• Use the service to store, process, or transmit malicious content;
• Abuse the credit system by creating multiple accounts or exploiting bugs;
• Scrape, reverse-engineer, or attempt to extract our platform's source code or implementation details;
• Use the affiliate program for spam, deceptive marketing, or self-referrals;
• Share account credentials or allow unauthorized access to your workspace;
• Exceed the team seat, scenario, or usage limits of your current plan;
• Use the service for any activity that violates applicable law.

We monitor for AI security incidents including injection attempts and may log, rate-limit, or suspend accounts that engage in abusive behavior.

10. Intellectual Property

SaasDash.ai, its design, source code, user interface, and branding are the exclusive property of Pmc Negocios Digitais Ltda. All rights not expressly granted herein are reserved. The platform implements industry-standard SaaS metrics tools and methodologies. Certain framework names referenced in the platform may be trademarks of their respective owners and are used for descriptive purposes only.

You retain full ownership of all business data and metrics you enter into the platform ("Customer Inputs"). For AI outputs generated specifically in response to your Customer Inputs ("Customer Outputs"), we grant you a non-exclusive, worldwide, royalty-free license to use them for any lawful purpose, and SaasDash claims no proprietary rights in your Customer Outputs. Note that AI models may produce outputs that are similar across customers; we make no representation that any particular Customer Output is unique or original.

11. Data & Privacy

Your use of SaasDash.ai is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. Cookies are described in our Cookie Policy. By using the service, you consent to the data practices described therein.

12. Data Processing Agreement

When you use SaasDash.ai to process personal data about your end users, employees, or other individuals, you are the "controller" and we act as your "processor" under GDPR Art. 28 and analogous LGPD provisions. Our standard Data Processing Agreement governs that relationship and is available on request — see /legal/dpa for instructions on how to request a signed copy. The DPA includes the EU Standard Contractual Clauses (Decision 2021/914) and the UK International Data Transfer Addendum where applicable.

13. Sub-processors

We rely on a curated set of sub-processors to deliver the service. The current list, including each vendor's purpose, hosting region, and transfer mechanism for EU/UK data, is published at /sub-processors. We will provide at least 30 days' notice on that page before adding or materially changing a sub-processor that handles personal data.

14. Disclaimer of Warranties

SaasDash.ai is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that Growth Ceiling predictions, AI-generated insights, or any metrics calculations will be accurate, complete, or suitable for making business decisions. SaaS metrics are inherently based on assumptions and historical data that may not reflect future performance.

Our AI features use third-party language models (Anthropic Claude) and may produce inaccurate, incomplete, or misleading responses. You should independently verify any AI-generated advice before acting on it.

15. Limitation of Liability

To the maximum extent permitted by law, SaasDash.ai and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, lost profits, loss of business, or loss of data arising from your use of or inability to use the service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim. Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable consumer protection law.

16. Indemnification

By SaasDash:We will defend and indemnify you against any third-party claim alleging that your authorized use of the SaasDash platform itself infringes that third party's intellectual property rights, and we will pay damages and reasonable costs finally awarded against you on such a claim.

By you:You will defend and indemnify SaasDash against any third-party claim arising out of (a) content or data you upload, store, or transmit through the service that violates applicable law or a third party's rights, (b) your breach of these Terms or the Acceptable Use section, or (c) your use of the service in a manner not authorized by these Terms.

Indemnification under this section is conditioned on prompt written notice of the claim, reasonable cooperation, and the indemnifying party's right to control the defense and any settlement.

17. Export Controls & Sanctions

You represent that you are not located in, under the control of, or a national or resident of any country or person subject to comprehensive U.S., EU, UK, or UN sanctions (including, currently, Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine), and that you are not on any U.S. or other government denied-party or restricted-party list. You will not use the service in violation of applicable export-control or sanctions laws.

18. Termination

You may cancel your account at any time through account settings or by contacting us. We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or fail to pay subscription fees. Upon termination, your right to use the service ceases immediately. We will retain your data for 30 days to allow for data export, after which it will be permanently deleted unless required by law.

19. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes via email or a prominent notice on the website at least 30 days before they take effect. Continued use of SaasDash.ai after changes become effective constitutes acceptance of the revised Terms.

20. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Federative Republic of Brazil, without regard to its conflict-of-laws principles. Any disputes shall be resolved in the courts of São Paulo, SP, Brazil.

EU consumer carve-out: Nothing in this section deprives you, as a consumer in the European Union, the United Kingdom, or any other jurisdiction that provides mandatory consumer protection, of the protection of the laws of your country of habitual residence and the jurisdiction of your local courts.
